Stepparent Visitation

A stepparent or close relatives of a deceased parent may petition the court to grant reasonable visitation if it is determined to be in the best interest of the child. Close relatives are considered to be siblings, parents and grandparents. If someone other than these persons should petition for visitation, the court will consider the amount of personal contact between that person and the child before the application was made. Family Code Section 3101 provides for stepparent visitation and Section 3102 provides for relative visitation. If the child has been adopted, the code section for visitation of relatives does not apply.
